Boyd Family Law Dec. 29, 2021

A divorce is never easy for anyone involved – particularly the children if they are still minors. If you have already made the decision to pursue a divorce, and you believe there will be contested issues relating to the children, one of the best things you can do for yourself is to retain the services of a Fort Worth father’s rights attorney. As a father, you have a number of rights as well as responsibilities regarding your children. To ensure that you understand those rights and responsibilities you need an attorney who can relate to you and your situation and who will make sure your interests are protected throughout the divorce process. While your attorney is working hard to protect you and your interests, there are things you can do to help your attorney as well. Consider the following five things you can do to help your Fort Worth father’s rights attorney.

  • Be truthful with your attorney. One of the biggest mistakes people make in any type of litigation is not being truthful with their attorney. There are an infinite number of reasons why people hold things back from their attorney; however, the end result is always the same. Your attorney is working with missing or inaccurate information. This is an attorney’s worst nightmare because is inevitably leads to blindsided in court. That, in turn, can result in losing the case. To prevent this from happening, always be truthful and forthcoming with your attorney. Remember, you are protected by the attorney-client privilege, meaning anything you say to your attorney must be kept confidential by your attorney. Also,

  • Document, document, document. Keep written records of everything during your divorce. If you buy your children school clothes, keep the receipt. If you pay your spouse’s credit card bill, make a note. If your spouse won’t let you have the children this week-end, write it down in a journal. If your case ends up at trial, having all of that documentation could be the deciding factor that turns the case in your direction. It could also be the incentive your spouse needs to settle.

  • Keep your cool. This can be difficult – but try very hard! If you end up in a battle over your children, your behavior throughout the case to date will matter. The judge has a legal duty to do what is in the best interest of the child. That often equates to placing the child in the most stable environment. If the judge sees you as a “hothead” you are unlikely to be viewed as “stable.”

  • Abide by temporary orders. While a divorce is pending, it is common for the judge to issue some preliminary orders relating to temporary custody of the children, possession of the marital residence, spousal and child support, and things of that nature. The orders may not be in favor; however, remember that these order are only preliminary orders. Your attorney may be able to get them modified during the pendency of the divorce or, if not then, in the final decree. Do not make the mistake of blowing the entire case for yourself by violating a direct court order while the case is pending.

  • Be responsible. This is somewhat vague and all-encompassing; however, it is still applicable. Your attorney needs to present the judge will a mature, responsible, and capable parent. You can help your father’s rights attorney do this by acting responsibly throughout the litigation of your divorce.

By doing these five things you will help your Fort Worth father’s rights attorney to help you. Although times have certainly changed, it remains a challenge for fathers fighting for their children in a divorce. Having the right attorney on your side can make all the difference in the world. As the client, doing what you can to help your attorney only makes sense.
